Story # 1 – Timing Tactics: Process Server’s Gatebreak Success
It’s one thing to track down a recipient to their home address, the next hurdle is reaching their front door.
In this example, our field agent had to deliver papers to a recipient regarding a parenting issue. This person lived on a property with a locked gate. There was no way for the field agent to get to the front door of their home without breaking any trespassing laws.
After attempting to access the property on four different occasions, the field agent realised they needed to find a work around.
Our client advised that a mowing man attended the property at a particular time each week. The field agent realised that the recipient would have to open the gate to give them access to the yard.
The agent arranged to arrive at the property at around the same time as the mowing man and saw the gate was unlocked. They were then able to legally enter the property, knock on the door and serve the papers successfully.
Sometimes, timing is everything.
Story # 2 – Sensitive Approach Safeguards Recipient’s Privacy
We often assist with serving papers in sensitive legal matters, such as for divorce or domestic violence cases.
When a woman is the recipient of the paperwork in these cases, they are often frightened of their ex-partner finding out where they are located, even though they usually want the matter to proceed.
In such scenarios, our field agents try to find an approach that makes the recipient comfortable. For example, we needed to serve divorce papers to a woman who was very reluctant for anyone to know her new home address. She wanted the divorce to proceed and therefore knew she had to be served court documents, but did not want to provide her ex with an address to be served at as she didn’t want to risk the chance of any confrontations with him.
We arranged for a female field agent to work on this case. The agent contacted the woman on the phone and suggested they meet at a public place so that she could be comfortable with the situation. The woman was agreeable and suggested they meet at a fast food restaurant during a busy time.
This is an approach we have used many times to great success. In this case, the papers were served and the parties involved were able to move forward.
