To help you get divorce documents in the hands of the right person, Servedoc has access to a team of experienced process servers which we can coordinate with on your behalf.
We assist both lawyers working on divorce cases, as well as individuals who are organising their own divorces. Our servers operate nationally across Australia and we also offer assistance with international process serving in most countries.
Even if a divorce is proceeding amicably, arranging all the necessary paperwork can be stressful.
If you’re planning to initiate divorce proceedings without involving a lawyer, you can opt for a trusted friend or family member to serve divorce papers on your behalf – you cannot legally serve the papers yourself. However be aware that the person serving the papers must acquire the necessary signed Acknowledgement of Service. The person who serves the papers must also sign an Affidavit of Service by Hand (Divorce). This Affidavit and any signed Acknowledgment of Service must both be signed before the same Justice of the Peace, then filed with the Court.
Opting for a processional process server makes everything much more straightforward, especially if the person being served is proving difficult to reach. Once a process server has successfully delivered your documents, you will be provided with a correct Affidavit of Service to be filed in the Court so that you can progress with the next step in your legal proceedings. This gives you peace of mind that your divorce case will not be unnecessarily dragged out.
We know that serving the right documents quickly and successfully is key to any legal proceeding. That is why we dedicate ourselves to efficient, experienced and wide-ranging services to help our clients with all they need. If you need a quick turnaround time and are dealing with a difficult to reach party, we are here for you.
The majority of our process servers work 6 to 7 days a week including nights and weekends. This helps to ensure attempts are made to personally serve your divorce documents at times when the recipient is likely to be home.
We can also conduct additional investigation in order to track down recipients if their address is unknown. Most of the process servers we engage have background experience in law enforcement or in the military, meaning they are able to keep calm if they find themselves in a confrontational situation. They know how to deescalate and understand the importance of abiding by trespass and privacy laws.
